Terms of Service
These Terms govern your use of the Nexxt Site Manager platform (the "Service"), operated by Nexxt Nest Group ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Nexxt Site Manager provides AI-assisted tools that help Australian builders and construction businesses draft documents such as progress claims, site documentation, quotes, compliance summaries and related material.
2. Eligibility and accounts
You must be at least 18 and using the Service for business purposes. You are responsible for your account, for keeping access to your email secure, and for all activity under your account. Sign-in is by secure email link.
3. Subscriptions and billing
Paid plans are billed in advance on a recurring basis through Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation, refunds and failed-payment handling are covered in our Refund & Cancellation Policy.
4. AI-generated output — important
The Service uses AI to produce drafts and working aids. AI output — including progress claims, SWMS, NCC and compliance summaries, quotes and similar documents — is not legal, financial, professional, engineering or compliance advice, and may contain errors or omissions.
You are solely responsible for reviewing, verifying and correcting every document before you rely on it, submit it, or provide it to any third party, and for ensuring it meets all applicable laws, standards and contractual requirements. Always confirm regulatory matters with the relevant authority or a qualified professional.
5. Acceptable use
You agree not to misuse the Service, including: attempting to break or overload it, accessing other users' data, using it unlawfully, or reselling access without our agreement.
6. Intellectual property
We own the platform, its software and branding. You retain ownership of the information you input, and of the documents you generate, and you are responsible for their use. You grant us the limited rights needed to operate the Service (for example, to process your input through our AI provider to generate your output).
7. Availability
We work to keep the Service reliable but do not guarantee it will be uninterrupted or error-free. We may modify, suspend or discontinue features.
8. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from your reliance on AI-generated output, and our total liability is limited to the amount you paid for the Service in the 12 months before the claim.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate accounts that breach these Terms or pose a security or legal risk.
10. Changes
We may update these Terms. Material changes will be notified through the Service or by email, and the "last updated" date will change. Continued use after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
